Case: Luis Boggiano, et al. v. Mount Sinai Medical Center of Florida, Case No. CACE-26-006904-09
Effective Date: July 10, 2026

This Privacy Policy applies only to this website (the “Settlement Website”), which was established solely to administer the settlement in the above-referenced case (the “Settlement”). It does not apply to any other website, including the general website of Atticus Administration LLC (“Atticus,” “we,” “us”), the Court-Appointed Settlement Administrator for this Settlement.

1. Information We Collect

We collect the following information only when you voluntarily submit it through the Claim Form on this site, or when you contact us:

  • Identifying information: name, mailing address, phone number, email address
  • Claim credentials: the Unique ID and PIN provided to you on your settlement notice
  • Payment selection: your chosen payment method (e.g., direct deposit, check, ACH), processed through our third-party disbursement provider (see Section 4)
  • Signature and date submitted with your Claim Form

We do not ask for or collect Social Security numbers, bank account numbers, or other sensitive financial account details directly through this site — those, if applicable, are collected only within the secure third-party payment widget described in Section 4.

2. No Analytics, Advertising, or Tracking Pixels

This site does not use Google Analytics, Meta Pixel, Google Ads remarketing tags, LinkedIn Insight Tag, Google Tag Manager, or any comparable analytics, advertising, or tracking pixel technology. We do not track your browsing activity across this or other websites, and we do not sell or share your personal information for cross-context behavioral advertising.

3. Cookies

This site uses only strictly necessary cookies required for the Claim Form to function securely, including:

  • A session cookie to maintain your progress while completing the Claim Form
  • A security/anti-fraud cookie (CSRF protection) to prevent unauthorized form submissions

These cookies do not track you across other websites and are not used for advertising or profiling. They expire when your session ends or shortly thereafter.

4. Third-Party Service Providers

We use a limited number of third-party tools solely to operate and secure the Claim Form. These providers act as our data processors and are contractually restricted from using your information for their own marketing purposes:

  • Google reCAPTCHA — used solely to detect and prevent automated/fraudulent form submissions. Google may set a cookie and process device/browser information for this purpose, per Google’s Privacy Policy. This is a security control, not analytics or advertising.
  • Digital Disbursements — used solely to process your selected settlement payment (direct deposit, check, or ACH). Any payment or banking details you provide are submitted directly to this provider and are subject to its own privacy notice, provided at the point of use.

We do not use any other third-party embeds, widgets, or scripts on this site.

5. How We Use Your Information

We use the information collected solely to:

  • Verify and process your Claim Form
  • Determine eligibility and calculate settlement payments
  • Issue payments via your selected method
  • Respond to inquiries about your claim
  • Comply with the Settlement Agreement, Court orders, and applicable law

We do not use your information for marketing, advertising, or any purpose unrelated to administering this Settlement.

6. How We Share Your Information

We share information only with:

  • Class Counsel, Defendant’s Counsel, and the Court, as required under the Settlement Agreement
  • Our payment processor (Digital Disbursements), solely to issue your payment
  • Regulators or other parties where required by law or court order

We do not sell, rent, or share your personal information with any third party for their own marketing purposes.

7. Data Security

We maintain administrative, technical, and physical safeguards designed to protect your information against unauthorized access, use, or disclosure, consistent with industry practices for handling settlement claims data.

8. Data Retention

We retain claim information only as long as necessary to administer the Settlement, respond to disputes or audits, and comply with the Settlement Agreement, Court orders, and applicable record-retention requirements. Information is securely disposed of or archived in accordance with our data retention procedures once these purposes are fulfilled.

9. Children’s Privacy

This site is not directed to children, and we do not knowingly collect information from children under 13.

10. Your Choices and Rights

Because this site does not use tracking, analytics, or advertising cookies, there are no ad-tech opt-outs applicable to this site. If you have questions about your claim or wish to request access to, correction of, or deletion of the information you submitted, contact us using the information below.

11. Changes to This Policy

We may update this Privacy Policy to reflect changes in the Settlement administration process or applicable law. Any changes will be posted on this page with a revised effective date.
